This Agreement ("Agreement") is between Brookesbell Academy LTD ("Company," "we," "us," or "our") and the client ("you") and governs your access and participation in our coaching programs, services, digital content, courses, and any related offerings (collectively, "the Program"). By purchasing, accessing, or participating in the Program, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions.
The Program is designed for personal development, providing education, guidance and coaching to support self-awareness, mindset shifts, and personal growth. We do not provide medical, psychological, legal, or financial advice. Coaching does not replace therapy, medical treatment, or any other professional legal/financial consultation. If you require medical or psychological assistance, please consult a registered and licensed professional. All educational content provided within the Program is for informational purposes only and intended for a general audience. The content must not be construed as medical advice, diagnosis, or counselling. If you have medical or psychological concerns, you must consult a
qualified medical professional or psychologist.
The program’s content focuses on:
Identifying and shifting limiting beliefs. Understanding belief systems and their impact on personal and professional growth. Developing emotional resilience and mindset mastery. Improving relationships with food, movement and self-care. Exploring personal health, well-being and longevity. While some participants may experience positive shifts in health, energy and body awareness, there is no guarantee of specific physical or body composition changes.
The Program does not prescribe structured meal plans, exercise routines, or medical interventions and should not replace professional health guidance.
The Program incorporates coaching tools and frameworks designed to help clients reframe perspectives, challenge unhelpful thought patterns and expand their capacity for self-leadership and personal success. However, these methodologies are not a substitute for mental health treatment or therapy.
Your success with the Program depends on your willingness to take action on the recommendations provided. Should you have any medical or healthcare concerns, please seek guidance from your registered medical professional before making any changes to your lifestyle.
Voluntary Participation – The Client consents to voluntarily participate in the Program online and its delivery of services as described under "Program Details."
Participation is voluntary and is entirely at the Client’s discretion.
Personal Responsibility – The Client assumes full responsibility for their well-being before, during, and after the Program. Any decisions, changes, or actions taken as a result of this Program are made at the Client’s own discretion and risk.
Not a Diagnostic or Treatment Service – The Client understands and agrees that this Program does not provide medical, psychological, legal, or financial advice. It is not a substitute for professional medical, psychological, or therapeutic treatment, and should not be used as such.
No Guarantees – The Client understands that no guarantees are made regarding specific outcomes or results. Success in the Program depends on individual effort, circumstances, and willingness to engage with the material.
Healthcare Responsibility – The Client agrees to: Continue seeking guidance from their registered medical provider for prescription medications, health conditions or any medical concerns. Participate in the Program only after receiving clearance from their healthcare provider, if necessary.
Awareness of Risk – The Client acknowledges that personal development and mindset work may involve exploring emotions, belief systems, and behavioural patterns. While the Program is designed to be supportive and empowering, the Client is responsible for seeking appropriate professional support if challenges arise.
Medical Emergencies – In the event of a medical or psychological emergency, the Client agrees to contact their local emergency services immediately.
The Program consists of a variety of coaching and educational components designed to support personal development, mindset shifts and skill-building. Depending on the specific Program purchased, this may include:
Online courses & training modules – Self-paced or structured learning materials available via the designated platform.
Live coaching calls & group sessions – Interactive coaching calls, group discussions and Q&A sessions.
Private coaching & messaging support – Direct coaching access via messaging platforms (such as voice note coaching or text-based support, if included in the selected Program).
Downloadable materials & resources – Workbooks, templates, exercises, and other supplementary content.
Community access & discussions – Participation in private groups, forums or exclusive communities for networking and support.
Access to Program materials is granted for the duration specified at checkout or in the program details. Program content is for individual use only and may not be shared, resold or distributed.
Certain Program elements, such as live coaching calls, messaging support, or community access, may be available for a limited time, as outlined in the purchase agreement.
Messaging and voice note coaching (if applicable) is provided within the designated response window and is not intended for 24/7 support. Boundaries for response times will be outlined upon enrolment.
Participation in group coaching, forums and online communities requires respectful and professional conduct. Harassment, abuse, discrimination, or solicitation of other members is strictly prohibited and may result in removal from the Program without a refund.
While we encourage open discussions, we cannot guarantee confidentiality in group settings. You agree not to share any private or proprietary information from the Program with third parties.
2.3 Modifications & Updates
The Company reserves the right to modify, update or discontinue certain aspects of the Program at any time to enhance quality or ensure compliance with best practices. Clients will be notified of significant changes affecting their access or engagement within the Program.
Payment for the Program and services must be made in full as stated at checkout, unless an approved payment plan is arranged. If a payment plan is selected, the Client agrees to complete all scheduled instalments, regardless of continued participation in the Program. Payments are processed securely via Stripe (or other designated third-party processors).
Pricing for future services may change without notice and the Client is not entitled to previous price points for new purchases.
If an instalment plan has been agreed upon (via website, social media, email, text, or other channels), this will be reflected at checkout and automatically charged to the nominated payment method on file.
The Client authorises automatic recurring billing for all scheduled payments under their selected plan.
Payments will be charged on the agreed schedule until the total balance is paid.
If a scheduled payment fails, it will be retried after 3 days. If payment remains unresolved, the Client’s access to the Program may be suspended or terminated until payment is rectified.
Continued failure to pay may result in further collection actions, including legal proceedings, reporting non-payment or additional fees for recovery.
All sales are final. No refunds, cancellations, or chargebacks will be issued unless required by law. If the Client voluntarily withdraws from the Program at any time, they remain responsible for any outstanding payments on their account. Digital services, goods and personalised coaching are non-refundable due to the nature of the Program.
The Client agrees not to initiate chargebacks or payment disputes for any reason, including claims of:
Fraudulent transactions, Services not received, Accidental purchases, Changes in personal circumstances.
If a chargeback is initiated, we reserve the right to: Pursue full collection of outstanding balances, Report non-payment to credit agencies or collection services, Deny future access to our services and Programs, Seek legal recourse to recover funds.
The Client understands that Program access is granted upon purchase and the coaching term begins regardless of when the Client chooses to start engagement. Once the Program has started, it cannot be paused, suspended or transferred to another individual. The Client agrees to pay the full Program fee, whether upfront or via instalments and remains responsible for completing all scheduled payments.
If the Client is enrolled in a membership subscription, cancellation is only permitted after the minimum commitment term has been completed. The Client must submit a written cancellation request via email with no less than 30 days' notice before the next billing cycle. If a cancellation request is submitted less than 30 days before the next billing cycle, the final payment will still be processed and cancellation will take effect from the following billing cycle.
No refund will be issued for failure to submit a cancellation request, resulting in continued billing. The Client is solely responsible for ensuring their cancellation request is received and processed within the required timeframe. Failure to submit a written request in accordance with this policy will result in continued billing and the Client will be responsible for all charges incurred.
All content, including videos, text, PDFs, frameworks and proprietary methods, is the intellectual property of the Company. You are granted a limited, non-transferable, revocable license to access and use the materials for personal purposes only. You may not resell, share, or repurpose any content for commercial gain.
Copying, redistributing, or repackaging Program materials is strictly prohibited. If unauthorised use is discovered, we reserve the right to terminate access and take legal action.
4.3 Website Use & Freely Accessible Materials
The Company may provide free content including but not limited to; resources, downloads, blog articles, social media posts, webinars, or other educational materials ("Free Materials").
Free Materials are provided for informational and educational purposes only and do not constitute coaching, professional advice, or a contractual agreement. The use of any information, strategies, or recommendations from free materials is at the Client’s own risk and discretion. The Company is not liable for any decisions, actions, or consequences arising from the use of freely accessible materials.
Accessing or using Free Materials does not establish a coaching relationship, client agreement, or any obligation between the Company and the User.
The Company reserves the right to modify, update, or discontinue Free Materials at any time without prior notice.
The User may not reproduce, distribute, modify, or sell Free Materials without the Company’s written consent.
The Company is not liable for any decisions, actions, or outcomes based on the use of Free Materials.
Your success in the Program is directly related to your engagement and effort. It is your responsibility to complete assigned tasks, implement strategies and actively seek support when needed.
You agree to participate in a respectful and professional manner in all Program interactions. Violation of community standards, abuse or harassment in any format may result in termination of access without refund.
We reserve the right to terminate your access without refund if:
You fail to make required payments. You violate these Terms and Conditions. You engage in unethical, inappropriate, or disruptive behaviour.
If you wish to cancel your participation, you must notify us in writing. No refunds will be issued for cancellations.
The Company shall not be liable for direct, indirect, incidental or consequential damages arising from participation in the Program. The Client acknowledges that results depend on individual effort, external circumstances, and factors beyond the Company’s control. The total liability of the Company for any claim shall not exceed the amount paid by the Client for the Program.
The Client assumes full responsibility for their health decisions, actions, dietary choices, and supplement intake. The Company does not provide medical advice or guarantee specific health, fitness or well-being outcomes. Clients must consult a registered medical provider before making any changes to diet, exercise or supplement intake. The Company is not liable for any health complications that may arise from following coaching recommendations or educational content.
The Client agrees to indemnify and hold harmless the Company, its employees, contractors, and affiliates from any claims, losses, or damages resulting from participation in the Program.
If a dispute arises, both parties agree to attempt mediation with an independent mediator before pursuing legal action.
The Client agrees not to escalate the matter to litigation or other dispute resolution methods without attempting mediation in good faith.
This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales. Any legal proceedings shall take place in the jurisdiction of England and Wales.
The Company and its coaches shall not be involved in any external legal disputes the Client may be engaged in that are unrelated to this Agreement.
The Company respects client confidentiality and will not share personal information without consent, except: If required by law. If there is a risk of harm to the Client or others
The Company processes personal data in accordance with UK GDPR and the Data Protection Act 2018. Personal data is retained for up to 10 years as per IPHM (International Practitioners of Holistic Medicine) standards. The Client’s use of the Company’s services is subject to the Privacy Policy, and by enrolling, the Client consents to the collection and processing of data as outlined therein.
By enrolling in the Program, the Client grants the Company permission to use: Name, photograph, likeness, voice, testimonials and biographical material. For purposes including but not limited to public relations, education, advertising, marketing, training, and research. This consent applies without restriction on time, location, or geographic boundary. The Client waives any right to claim payment or royalties for the use of such materials.
If the Client wishes to opt out, they must submit a written request to the Company.
The Company shall not be held liable for any failure or delay in performance due to unforeseen circumstances, including: Natural disasters, Pandemics or public health emergencies, Acts of war or terrorism, Government restrictions or regulations, Any event beyond the Company’s control.
By purchasing or participating in the Program, you acknowledge and agree to these Terms and Conditions. While we do not anticipate frequent changes, The company reserves the right to modify the policy at its discretion without notice to users.
